Terms of Service

Overview

Freer Games is an independent developer offering the Services. These Terms of Service ("Terms") form a legal agreement between you and Freer Games regarding your use of Freer Tennis and Freer Games' websites, services, games, and applications (collectively, the "Services").

By using the Services, you agree to these Terms. If you do not agree, do not purchase or use the Services.

1. License and Restrictions

Subject to these Terms, Freer Games grants a non-exclusive, limited, revocable, non-transferable license for personal, non-commercial use of the Services.

You may not:

• Reverse or alter the Services: modify, translate, reverse-engineer, reverse-compile, decompile, disassemble, create derivative works of, or use data gathering or extraction tools in connection with the Services.
• Exploit the Services commercially: reproduce, duplicate, copy, sell, resell, or otherwise exploit the Services, in whole or in part, without Freer Games' express written consent.
• Enclose proprietary content: frame or use framing techniques to enclose any trademark, logo, image, text, page layout, form, or other proprietary information without the express written consent of the respective owner.
• Use automation tools: use data mining, spiders, crawlers, scripts, bots, or any automated method of collecting information.
• Use hidden text: use meta-tags or hidden text that refer to Freer Games, its partners, or artists without express written permission.
• Engage in illegal conduct: engage in illegal or tortious conduct in connection with the Services, including hacking the Services or infringing the intellectual property or other proprietary rights of Freer Games or third parties.

Where the Services include a downloadable game or application ("App"), Freer Games grants you a non-exclusive, non-transferable, revocable, limited license to use the App for your personal, non-commercial use on authorized devices, unless otherwise specified. The App may not be copied, resold, or sublicensed. These Terms apply to all versions and updates of the App, including both free and paid versions.

The App may include technical measures to control access, prevent unauthorized copies, or stop users from exceeding the limited rights granted under these Terms. If you disable or tamper with those measures, your license to use the App or Services may be automatically revoked.

2. Third-Party Products, Services and Links

Third-party products, services, and linked resources remain governed by their own terms and policies.

Freer Games may offer third-party products through the Services. You assume all risks and liabilities associated with the use of those products. Your rights and obligations regarding third-party products or services are governed by the separate terms and privacy policies of the applicable provider.

The Services may also include links to websites or resources over which Freer Games has no control. Freer Games is not responsible for the availability, content, advertising, products, or other materials on those external websites or resources.

3. Access to the Services

Access to the Services may depend on age, parental involvement, and compliance with account rules.

By using the Services, you affirm that you are at least 18 years old, or have reached the age of majority where you live, or that you have reviewed these Terms with a parent or guardian who accepts them on your behalf and takes responsibility for your compliance. If you are under 13, you must have permission from a parent or guardian in order to use the Services. If you do not have that permission, certain features and functionality may be disabled. Information about the handling of personal information is described in Freer Games' Privacy Policy or a service-specific privacy policy.

You may be required to register an account ("Account") before using certain Services, and you may also be required or given the option to sign in through a platform account (such as Google Play Games or Apple Game Center). Your Account is personal to you and may not be rented, leased, sold, traded, gifted, bequeathed, or otherwise transferred. You agree to provide true and complete information when registering and to keep that information up to date. You may not have more than one Account or access the Services through more than one platform account at a time. You are solely responsible for maintaining the confidentiality of your password and username and for activities that occur under your Account.

Freer Games does not authorize the use of automated methods to sign up for an Account and reserves the right to immediately terminate your access to the Services or your Account if you breach these Terms or violate applicable law, rules, or regulations in your jurisdiction.

By using the Services and providing contact information, you explicitly consent to receive communications from Freer Games. If you do not wish to receive those communications, please review Freer Games' Privacy Policy and the available opt-out procedures.

Account Deletion

You may request deletion of your Freer Tennis account through the dedicated public request page.

To start a deletion request, visit the Account Deletion Request page and provide the requested information. We may ask for additional details to verify the request before deletion is completed.

4. In-Game Virtual Currency and Virtual Items

Virtual Currency and Virtual Items are licensed digital features inside the Services and are not real currency or property.

The Services may allow you to earn, buy, or otherwise obtain in-game currency ("Virtual Currency") and use it to access virtual, in-game digital goods or items ("Virtual Items"). Methods of obtaining Virtual Currency are at Freer Games' sole discretion. Virtual Currency and Virtual Items are not real currency, do not have monetary value, and may not be redeemed for legal currency or items of value outside the Services.

Virtual Currency and Virtual Items obtained through the Services are provided under a limited, personal, revocable, non-transferable, non-sublicensable license for use only within the Services. You have no property interest, right, or title in any Virtual Currency or Virtual Item appearing in or originating from the Services, and they may not be transferred or resold, including through direct sales or auction services.

All sales of Virtual Currency and Virtual Items are final. No refunds will be given except in Freer Games' sole and absolute discretion or where required by applicable law or the policies of the applicable app store. Freer Games has no liability for hacking, loss of Virtual Currency or Virtual Items, or goods or services obtained through Virtual Currency. Freer Games has no obligation to reimburse you for Virtual Currency or Virtual Items and reserves the right, in its sole discretion and without prior notice, to change or limit the price, availability, or order quantity of any Virtual Currency or Virtual Item and to refuse to provide them.

Virtual Currency may have an expiration date. If Virtual Currency or Virtual Items expire while you still have an active Account, Freer Games may, in its sole discretion, offer to convert expired Virtual Currency into Virtual Items, but it is under no obligation to do so. Virtual Currency and Virtual Items may be forfeited if your Account or access to the Services is terminated or suspended, if you breach these Terms, if Freer Games discontinues the Service, or if you disassociate from the Service.

5. Advancements, Quality and Deficiencies, Roll-Back and Beta Testing

Roll-Backs and Beta participation may affect progress, purchases, stability, and available content.

In exceptional cases such as updates or error rectifications, it may be required to reset the App to an earlier status in order to prevent greater damage ("Roll-Back"). In that context, App progress, App scores, high scores, achievements, or accomplishments, and similar items may be reset to a corresponding earlier status, and interim changes or developments may be lost. Any real money purchases made between the time the Roll-Back is initiated and the time to which the App system is rolled back will not be refunded, but instead will be granted to you once more as part of the Roll-Back. Further claims are excluded unless otherwise specified in these Terms.

Freer Games is entitled, but not obliged, to grant users a voluntary bonus, for example in the form of virtual currency or premium features. Whether such a bonus is granted is at Freer Games' discretion and does not oblige Freer Games to grant a bonus during future Roll-Backs to the same or other users.

Freer Games may offer participation in or use of App elements, Services, and content that are not yet running smoothly ("Beta"). Beta may include programming errors, including serious ones, known or unknown to Freer Games, and may cause the App or your device to crash. During Beta, Freer Games may delete or add content, search for errors, improve the game experience, reset game scores, install backups, or create specific game scores. You are not entitled to restoration of a specific game status. Freer Games may extend or shorten any Beta in whole or in part at any time.

6. Online Content and Conduct

Forum Content remains the responsibility of the user who posts it, and Freer Games may monitor or remove it in its discretion.

The Services may include in-game chats and other features that allow you to create, submit, post, display, transmit, publish, perform, or distribute links, writings, photos, graphics, or other material ("Forum Content") through a forum or similar area ("Forum"). All Forum Content posted by you is your sole responsibility.

"Inappropriate Activity" means any conduct that violates these Terms or is harmful to the Services or other users, including cheating, using unauthorized third-party software, harassment, posting offensive or unlawful content, fraud, or attempts to gain unauthorized access to the Services or other users' accounts.

Forums may be used only in a noncommercial manner. Freer Games has the right, but not the responsibility, to monitor or remove Forum Content that it believes is harmful, offensive, or otherwise violates these Terms, and may restrict or disable your use of the Forums in its sole discretion.

By submitting Forum Content, you represent and warrant that you have all rights necessary to submit it and grant Freer Games a fully paid, royalty-free, non-exclusive, irrevocable, worldwide, unconditional, perpetual license to use, reproduce, modify, publicly display and perform, create derivative works of, sublicense, and distribute that Forum Content in any media now known or later developed, and to incorporate it into other works in any form, media, or technology.

Opinions, advice, statements, services, offers, and other content made available by third parties in the Forums are those of the respective authors, not of Freer Games. Freer Games is not responsible for their accuracy or reliability and makes no representations or warranties regarding the Forums.

Freer Games will not be liable to you or any third party for Forum Content, Inappropriate Activity, or resulting damage or loss.

7. Title

Ownership of the Services and Freer Games Content remains with Freer Games and/or its suppliers except as otherwise specified.

Unless otherwise specified in these Terms, all title, ownership, rights, and intellectual property rights in and to the Services, including all content within them (collectively, "Freer Games Content"), remain with Freer Games and/or its suppliers and are protected by copyright and other applicable laws. You may not use, copy, transmit, modify, distribute, or create derivative works from the Services or Freer Games Content without prior written consent from Freer Games.

The Services may allow you to create content ("Your Content") that incorporates Freer Games Content, including, but not limited to, photos incorporating elements or graphics from games, screenshots, or gameplay videos. Freer Games retains all rights, title, and interest in Freer Games Content. You retain rights in Your Content; provided, however, that Freer Games shall have a non-exclusive, perpetual, irrevocable, fully transferable, sublicensable, worldwide right and license to Your Content for any purpose, including reproducing, copying, adapting, modifying, performing, displaying, publishing, broadcasting, transmitting, distributing, or otherwise communicating it to the public by any means now known or later developed, without further notice or compensation to you.

Except where prohibited by law, you waive any moral rights of paternity, publication, reputation, or attribution with respect to Freer Games' use of Your Content.

8. Disclaimer of Warranty and Limit of Liability

The Services are provided "as is." To the maximum extent permitted by applicable law, all conditions, representations, and warranties, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, title, fitness for a particular purpose, and non-infringement, are disclaimed. Freer Games also makes no representations or warranties concerning the operation of the Services or the information, content, communications, materials, products, or services contained within them. Your use of the Services is at your sole risk.

Freer Games will not be liable for damages of any kind arising from your use of the Services, including direct, indirect, incidental, punitive, and consequential damages. Certain regional laws do not allow limitations on implied warranties or the exclusion or limitation of certain damages. If those laws apply to you, some or all of these disclaimers, exclusions, or limitations may not apply, and you may have additional rights.

You further acknowledge that Freer Games is not liable, and you agree not to hold Freer Games liable, for the conduct of third parties, including other users of the Services and third-party sites. The risk of using or accessing the Services, and the risk of injury arising from those uses, rests entirely with you.

9. Termination

These Terms may terminate automatically if you fail to comply, and Freer Games may terminate access or Accounts without notice.

These Terms will automatically terminate if you fail to comply with any term. You and Freer Games each have the right to terminate or cancel your Account at any time, for any reason, and without notice. Upon termination, you must immediately stop using the Services. Your obligations under Sections 4, 6, 7, 8, 10, 11, and 12 survive termination.

10. No Assignment

These Terms and the licenses granted to you are personal to you and may not be assigned without Freer Games' express written consent.

11. Infringement Notification

Any claims related to the Services should be addressed to freergames@outlook.com.

12. General

These Terms, together with the Privacy Policy and any applicable service-specific privacy policy, form the complete agreement governing use of the Services.

These Terms, together with the Privacy Policy and any other privacy policy applicable to the specific Services you use, constitute the complete and final agreement between you and Freer Games regarding your use of the Services. They may not be modified by you except in a written agreement signed by you and Freer Games.

Freer Games may make changes to the Services, these Terms, or its Privacy Policy from time to time and will use reasonable efforts to provide notice of material changes. Such changes become effective immediately upon notice and/or posting. If any such change is deemed invalid, void, or unenforceable for any reason, that change will be deemed severable and will not affect the validity or enforceability of any unchanged portions of the Services, these Terms, or the Privacy Policy.

Freer Games may transfer or assign the Services, these Terms, or the Privacy Policy, in whole or in part, to any third party of its choosing. These Terms will inure to the benefit of and be binding upon Freer Games' successors and assigns.
